Does not help our cause much when people like this are destroying the resource BUT to report him before he gets to the dock is going to be difficult. They would really need to check other members on the boat as well. I hope everyone’s bliners were long enough. Also you don’t know who else he had on board that would vouch for the fish either.
Greg you are correct on being his PERSONAL limit but how many people on this site actually catch their 5 Bliners and stop, or their 1 gag? Honestly? I mean I always do because breaking the law is bad! But not everyone is like me.
Also the cooler scenario, how many others are walking across the parking lot carrying a cooler while their buddies are hitting the head to bleed off that last 5 beers??
Not to mention he was Asian and we all know what happens when someone from a “minority” is targeted while others in the “majority” appear to be walking freely.
Sounds like the crew did what they could with in reason. Yes technically they could have done some kind of sting when they got back but there are lots of loop holes for him to wiggle out of.
I would suggest the captain inviting an undercover officer on board if this continues and take care of the problem on the spot, OR not let this guy back on board.

Screamin’ 4 Nookie (sorry, reference to you having a newborn and things being in recovery for a while)… It’s been done before. A handful of badges show up at the boat when they pull into port and the tickets start flying. Very easy to contact them over the VHF or Cellphone.
S4G’s - I’m not certain about the capts responsibility to call DNR. But I would seriously bet that if he had warned the guy, knew there were undersized fish and limit discrepancies on board, and did not contact DNR, he would be liable for something. Not certain what, but it would be something.
As far as DNR knowing what they need to do to make the bust, this ain’t their first rodeo…

I have heard bad things that happened to individuals that have done what you are suggesting in our local waters.

That was my 1st thought. I know of that program, but since it was NC, I figured calling that number would be pointless, though they may have been able to give me a NC number…
On the docks, there wasn’t any DNR related literature posted. All they had were flyers for Homeland Security stating to contact them if anyone is taking pictures of the ships/ports/docks/etc. It also said not to take pictures; sadly, there was no DNR number.
The Capt easily could of called ahead and let DNR know whats taking place, any law abiding Captain would do this.

Seems to me DNR has given many of tickets to folks getting off the head boats at Shem Creek here when they were in operation. I have been by there and have seen them inspectiing coolers. Anyone here remember when DNR was doing this?
I wouldn’t want to fish on a headboat who’s captain refuses to at least speak with a passenger who is violating regs. As the boat’s master, it’s his responsibility. If the passenger doesn’t comply, then he should have radioed or called ahead and had the DNR waiting at the dock. Sure, it would have pissed the guy off, but by not doing it, he pissed off everyone else who followed the regs.

I do remember Cane pole.If Im not mistaken,the unclaimed stringers of too many b liners were ticketed to the captain.That trip cost him a whole lot of duckets.
I used to fish the Carolina Clipper out of Chrleston years ago. Sometimes the DNR would be waiting at the dock. The people who had the shorts and over the limit got the ticket. Saw a guy do the same thing as a you were talking about. My guess is the Captain did report him because as soon as he stepped off the boat a couple of DNR guys came out of no where and checked him. I also noticed a couple of other coolers were left on the boat.

If nobody takes credit for his extra fish then he is stuck with them.
FYI…if you go trout fishing with your buddy and catch two limits of trout and he has to split as soon as you get back to the dock and the game warden comes up to you while you’re cleaning fish you can get nailed.

Maybe the law should be changed, and the captain of these head boats should be charged as well. After all, the laws on limits are to benefit all of us in the future.
As far as the negative publicity in a bad economy, it could just get worse with limited recources.

You don't need a fishing permit on a headboat. But what do you think that the captain can do to enforce the law? He is not a trained LEO. What happens when the patron says, "No, get away from me before I stab you with a rusty fillet knife". Do you really want to put a captain of a headboat in danger when his primary responsibility is for the safety of his passengers?
The bottom line is that the captain and mate are there to inform\advise the patrons to follow the law and if they don’t, have a man with a badge waiting at the dock for them. It really is that simple folks.
Not to change the subject but the last I heard was the older gentlemen that had a controlling interest in the Hurricane Fleet had passed away and the family members were squabling over assets and that they shut the doors to the biz. When did it re-open and are they still running all of the boats or just the head boats??
As for the dirt bag breaking creel limits with undersized fish, I say call the DNR with a license plate number and have him pulled over on the highway, away from the dock. Would that not solve all of the above issues for the most part??

Skinneej, you are right! But I would back a bill 100% to require any fishermen to carry a permit just as I have had to do for years.
I dont think that the captain should be required to do anything except ask him to follow the rules and report ALL known violations before they get to the hill.

Better make sure no one shares fish either. If little Johny only caught one BSB his dad better not pin the 6th Bliner on him. The captain really needs Microsoft excel and a computer to take names with. They must ALL be punished I tell you!!
As I mentioned before I feel like the captain and crew did what they could. Who knows they may have called DNR but no one showed up due to other priorities. The captain should not let this guy back on his boat. It will be trouble for everyone at some point if he continues.
