March 3 Circle Hooks

The new circle hook regulation says “…in federal waters of the South Atlantic” (http://www.safmc.net/LinkClick.aspx?fileticket=5Fp0q3sslVA%3D&tabid=139). Exactly where do the federal waters start? Are inshore bridges and docks considered federal waters?

3 miles from shore… Should be on a true navigation chart. We are really referring to those people targetting sheepshead beyond the demarcation line which includes most of the nearshore artificial reefs.

Actually, the whole reason I mentioned circle hooks was because I got a news release from SCDNR. It says Federal and State waters. See this link. http://www.dnr.sc.gov/news/yr2011/march3/march3_hook.html

“Species caught in state waters most affected by this new regulation include sheepshead, spadefish and black sea bass.”

But, here is the wording of the actual SAFMC bulletin:

“Beginning March 3, 2011, the use of non-stainless steel circle hooks (offset or non-offset) will be required on any vessel (commercial or recreational) using hook-and-line gear with natural baits to fish for snapper-grouper species north of 28 degrees N. latitude in federal waters</font id=“red”> of the South Atlantic. After March 3, 2011, it will be unlawful to possess snapper-grouper species north of 28 degrees N. latitude without possessing non-stainless steel circle hooks.”

You would have to call SCDNR to get the full detail about catching sheeps inside state waters, but they may have some kind of reciprocal rule or something that makes it less obvious.

Another thought to ponder on the non stainless steel circle hook issue. Gamakatsu’s circle hooks have a nickel silver black finish (rust resistant), and Owner’s cicle hooks have a black chrome finish (rust resistant). The point of non stainless is so the hooks will rust and dissolve if a fish breaks off your line. Some of the other hooks are rust resistant although they are not stainless steel. Technically, I would assume they are still legal. What do you think?

Circle hook, schmurkle hook, what is a circle hook anyway? Is an octopus circle hook really a circle hook? Does the point have to come back .02mm from the hook or .03mm? And if I bend my circle hook out am I breaking the law? Is the definition printed in the new amendment? I checked my tackle drawer today and I have 7 different types of circle hooks, 1 of which I catch the hell out of sheepshead on. But this particular hook to me is not a “true” circle hook however, because the point only turns in slightly to the shank of the hook. The package that they come in says they are “circle hooks.” I guess I will show the DNR officer my package if he checks me and hope for the best. Surely he will know whether or not I am in violation of the new schmurkle hook regulations.

I hate to sound like the rookie that I really am, but how do you know if the hooks are non-stainless? I’ve checked the packages of Gamakatsu and Lazer Sharp circle hooks, and there’s no indication as to whether they are stainless or non-stainless.
