My wife was in the truck the morning after a hog hunt. We were looking for a dog that had not returned. She was in her pajamas and the game warden told me if she was “Enjoying the hunt” she needed a license.

Here’s my Ben Moise story. My father in law came spur of the moment from out of state for Christmas one year back in the 90’s. We decided Christmas evening to go fishing the next day. My son who was probably abot 9-10 at the time came with us. We were fishing near Price Creek and Ben and his boykin came easing around the bend. That when I realized in our haste we hadn’t bought my FIL a license. Ben came up, and checked us. We were release fishing, all the safety items, registration, etc were in order. I told him before he even asked that my FIL didn’t have a license, how it was a spur of the moment last night planned trip, and it was my wrong for not remembering to get it. He gave my FIL a warning and told us to have a great day. Matter of fact, there was really no conversation or discussion about it. Honestly, I think he didn’t want to embarrass my FIL in front of his young grandson. That’s a classy guy right there.

I’ve been around the saltwater in Charleston for a pretty good lick, and I’ve never once had a poor or questionable encounter with a SCDNR warden.

Yep, they aren’t all jerks. I have a few friends at DNR. We tell em that nobody can shine a tailgate like a game warden.

I try to get everyone who steps in the boat a salt lic. Just easier when the man or these days, the lady stops by. Speeds up their look see and they can get out of there to take care of what comes up on the water.

I appreciate what DNR does. Never have had an issue in sc or elsewhere.

BTW, in SC, state law dictates that saltwater license revenue goes back into the fishery.

I think part of your drivers license fee goes to road repairs. How’s that working out for you?

Skinneeman how about this. The first Saturday in August you go out fishing in your double hulled craft. You come back in via the North Edisto inlet and go up Bohickett to the Rockville party. You’re rafted up with a bunch of boats and the party migrates to your boat. A ton of people and hotties dancing and partying on your craft. Since you were fishing earlier and have all those rods on the boat, does everyone one your boat need a saltwater fishing license? Like, if you were to get checked? And if DNR pulled up, would everyone on your boat get a ticket who didn’t have a license?

The part that if someone isn’t fishing they aren’t fishing. What part of that are you missing? You’re a smart boy, You should get that. Yes, if you have 6 bubbas in a boat all with their harley wife beater shirts on and their earnhart caps turned backwards, and one doesn’t have a license, well yeah, someones getting a ticket.

But, just b/c you have rods equaling the number of people on the boat, well, that ticket ain’t happenin.

The answer to the original question is, no, if you aren’t fishing you don’t need a license. Regardless of what the court of skinnee opinion says. Suck it up bubba. Your advice was wrong

Argue the legalities if you want to, or save a lot of hassle, spend the $10, or in my case $150, I buy non-resident licenses for myself, wife, son and daughter-in-law, every year in SC, and spend about the same in FL non-resident licenses every year. I consider it a bargain for what I get back.

Mr Cracker, The run in I had was an oversight on my part. Mr Moise is as cool a customer as there is. He even told me that if I needed to tuck in from a storm not to hesitate heading to his island and hiding out there.

I agree with spending the money on a license. But money is money and when government is involved I try to spend as little as possible. I appreciate your thoughts

So, was the blind man in the boat "hunting" or just riding along? My scenario is MUCH more in line with SoggyBottom's request than your hypothetical straw man scenario... Soggybottom is talking about people "tagging along" on a fishing trip. You are just making up stupid scenarios to save face on something you were incorrect about... Again, the blind mand scenario was NOT hypothetical. It was a REAL scenario where someone got a ticket for "tagging along". This was a REAL scenario where it would be practically impossible for this blind man to pick up a shot gun and safely harvest a marsh hen on his own merit. Thus, Moise nailed him (warning ticket though) on the *technicality* of the law. Later he was told by Judge Woods in Greenpond that he (Moise) was lucky that it was a warning ticket. Point being, Moise used his ***DISCRETION*** to write a ticket where 99% of other LEO's would have not written a ticket.

I answered the question. Pretty much all of the officers would determine (i.e. ****DISCRETION OF THE OFFICER IN PLAY***) that most of the "partiers" on the boat were not fishing and they would not be inclined to write tickets. In addition, not many people are fishing in Rockville during that event. In addition there are 10,000 witnesses at Rockville that can say that someone was not fishing, and 10,000 witnesses that can vouch for who came there by which boat. Anyone with an IQ of 25 or more would not write a ticket in this scenario. That being said, this scenario is not even close to what Soggybottom had asked about. This still doesn't excuse your bad advice. My advice on his scenario is solid and I still stand buy it.

Just for the record, I was in a duck boat with 2 other people when Ben Moise pulled up on us. 1 of the guys shot his gun ONCE 2 minutes before legal. It was actually about 5 minutes after several other boats had fired guns. Moise rolled up on us and informed us that someone is getting a ticket. He asked who shot early. I knew who did it, but wasn’t about to rat out a buddy. He gave us the option, either someone fess up and get a warning ticket, or all 3 of us would get REAL tickets for shooting early. How on earth could he issue 3 tickets for 1 shot fired? Doesn’t matter. Once you go to court at 2pm on a working day, you have already been punished. He was going to write us all tickets even though by the pigeonhole principle, it was obvious that 2 of us were innocent (one shot fired).

Honestly, the other problem that nobody has talked about is what happens if you are waylaying the fish? That’s what happens when I go fishing. You are catching fish left and right and having the time of your life. Suddenly, your guest says, “man, that looks like fun. Mind if I reel one in?” What are you going to do? Some officer’s would argue that if that guest so much as even helped you anchor, or held the rod while you were un-hooking a fish that they were engaging in fishing activities.

That being said, I love our local DNR. I’ve only had an issue with ONE of them (not mentioning names, cause the guy is a prick). I respect them very much and they have always been good\professional to me. Most of them are pretty cool and are sportsman just like us. But, I am no dummy… I know that if I am in the woods or on the water, and I piss of the wrong one, they could write me a ticket for anything they want and it would be my word against theirs.

Just buy a license to avoid the hassles that comes without one.
