texting ban: Charleston and Mt. Pleasant

If I can’t talk on the phone why can a cop talk on the radio or phone while driving. They do it all the time and the blue lights aren’t on!

Same reason why they can go over the speed limit without the blue lights when they are running late. Because they can.

you can still talk on the phone…that’s where the difficulty in policing is going to be, how to determine whether they are talking or texting…

We passed a no texting while driving law in TN a few yrs ago and I think in the first year there was one person cited for it statewide. It is passed for several reasons, the first one being a deterrent. I use this regularly with my 14 yr old daughter and letting her know that if she texts when she is old enough to drive that she could get arrested.
Secondly, it is used to further prosecute. If a person is texting and crashes and somebody dies, the law allows for further prosecution and to prove negligence. People abuse the law all the time and I’m guilty of it too. I am far from somebody who wants a police state and want as little govt intrusion into my life as possible but I find this can be a good demonstration of balance. As long as the cops don’t pull people over if they see them looking at their phones and use it only as an extra prosecution tool or deterrent I’m ok with it. Lord knows there are some stupid stupid drivers out there, it’s almost automatic for me to cuss somebody with an Ohio or Indiana plate…

BTW Police refer to them as 'Q-Tips' they get drunk driver or suspicious cars calls all the time. Dispatch: "We have a suspicious vehicle in the neighborhood." Officer: " 10-4, just a Q-Tip, she can't remember where she lives, I got her address from her ID and am escorting her home now." [:0]

It’s your call, of course, but you don’t have to ID yourself for law enforcement if they have no probably cause, or more accurately, reasonable suspicion. If you know and can articulate your rights, you have a pretty good chance of just walking away. You are not required to carry ID. You are not required to speak to police without PC. You simply say “Am I free to go?” Of course you may get your a$$ kicked, but probably not. :sunglasses:
