That is not at all what the Court did or said. The case now goes back to SC Family Court to determine what is now in the best interests of the child. To take her out of her father’s custody after 2 years might not be in the best interest of the child. This is just a really sad case with no easy answer for this child. At this point she has been with her father over half of her life and no doubt has few memories of her adoptive parents. Sad, sad, sad.

this is a case where the family court has too much power, screws up the best interest of the child under the guise of “What’s best for the child.” The family court - none of them - not the judge, nor either party’s lawyers, nor the guardians, are psychologists. They screw families up, especially children, all the time.
So, marshgrass, I know you are a lawyer… I understand what you are trying to say, but let’s turn this around and tell the full story approriately…
- The mother becomes pregnant. Natural mother refuses relationship with natural father even though he presses for marriage, as natural mother stated that he said he would get more pay from the service for a family.
- The father revokes his rights during the pregnancy and essentially abandons the mother after being asked by natural mother if he will pay child support or relinquish rights.
- Adoptive parents then meet mother, mother approves of them, and when she is delivering adoptive father cuts the cord during the delivery. Mind you, natural father is no where around, even though he is aware natural mother will be delivering.
- OK state says there is an issue since the child is Cherokee. However, father gives inappropriate info to the tribe and thus the tribe does NOT recognize him as Cherokee.

Look, I don’t think what has happened was right or fair. All I care about now is what would be best for this child. And I do not pretend to know what that is. That is what the Family Court has to decide. But whatever they decide there will be losers! Either the local couple or the dad (who has apparently been doing a good job as parent), but especially a little girl who may be (once again) taken from a family she has grown to love. There are no winners here!

The child is the real loser, having a biological father that just up and throws away his rights… of course he’s a good parent now… he would be a fool not to be with a federal case on the books. He’s still an ass for what he did to this child.
Whatcha wanna bet as soon as he was awarded custody to her that he called the job to notify them if a change of dependent status???
He’s an ass… if he wanted her, he would’ve fought for her from the start… and that’s what family court does, especially the courts of the low country… they destroy children and families, all in the name of “the best interest of the child” when they have no more psychology that an illiterate person walking through the psych section of Books-A-Million.
I hope that these parents take an active role in helping to reshape the family courts of America… especially SC’s, which is gender-biased no matter how much they want to state otherwise in their declarations. Bitter women can walk in to lawyers office and cry wolf all day long and snatch a kid up from a loving, caring father all cause they got issues. It’s not fair for dad’s and mom’s that get falsely accused of crap that leads to losing their children as they have expend every resource to get their child back, all at the ordering of the family cour
