Curious as to what the laws are on ownership and rights regarding marshes? If someone on here knows definitively I want to know. Can a person own the marsh behind they’re property? I was stopped recently by someone walking through the marsh on my way to a creek. I entered the marsh on public land and walked through the marsh flat to the creek and jumped down in the creek to fish. It is a short stretch of land with no house. Walked a good distance away from the piece of property, yet we were stopped and told that they own all the way out to the main body of water(i guess) which is like a 1/4 mile of marsh. I have done some research and cant find much. I figured before i call DNR i would reach out on here.
I think the short answer is that no one can own property up to high tide, but, there are some exceptions - I think dating back to “kings grant” type situations.

Owning and paying taxes is possible but they still, usually don’t control it. If it’s below the high water mark it’s usually OK to be there.

Yes they can own the marsh. It is a Kings Grant. Not a lot around but there are still some.
