There’s one in the Leadenwah now too…

Worst part is that homeowners are now stringing lines from their pierhead or floating dock to the base of their walkways to prevent casting into/under the docks. Really beginning to make me upset. Some docks I’ve been fishing all of my life are now unfishable because some jacka$$ moved here and bought the property and doesn’t want someone catching “their” fish.

Wouldn’t that be an unapproved modification to the dock?? Couldn’t OCRM be contacted and have them deal with the homeowner??

I know which dock you’re talking about. The sign says “Guides who fish private docks suck”. Good way to keep the guide boats away so the clients don’t start asking questions. It’s a decent spot to fish too. Had the guy come out on his dock one day, I politely asked him if he minded if we fished there a little longer and told him we didn’t want to be a nuisance if he was looking for some private time on the dock. Guy said it was no problem and he asked us if he could throw his cast net. Of course, it’s your dock. He then began throwing his net within inches of our bobbers. We got the hint and moved spots before we got any more annoyed.

SECTION 54-13-30. Trespassing on privately owned docks unlawful; posting of notice.

It shall be unlawful, except as provided herein, for any person to trespass upon or attach a boat or other device to any privately owned dock erected along the shores of any public or private waters within this State. Provided, however, that no person shall be convicted under this chapter unless the owner of such dock has posted a notice in a conspicuous place thereon stating that “Trespassing on this Dock is Prohibited by Law.” Any person violating the provisions of this chapter shall be deemed guilty of a misdemeanor and upon conviction shall be fined not less than twenty-five dollars nor more than one hundred dollars.

SECTION 48-39-130. Permits required to utilize critical areas.

This section is repealed effective July 1, 2026. See, Editor’s Note following this section.

(A) Ninety days after July 1, 1977, no person shall utilize a critical area for a use other than the use the critical area was devoted to on such date unless he has first obtained a permit from the department (DHEC).

SECTION 48-39-190. Lands not affected by chapter.

Nothing in this chapter shall affect the status of the title of the State or any person to any land below the mean highwater mark. The State shall in no way be liable for any damages as a result of the erection of permitted works.

based on these sections, the extent of a person’s right to exclude extends only to the “dock” itself. this is consistent w/ common law public trust doctrine in SC, which confers ownership/access to water below mean high tide to everyone. If someone is stringing lines to prevent fishing/walking below the mean high tide line, those lines would likely be considered not part of the “dock.” The scope of the dock would be limited to what was included in the use permit allowing installation of the dock, and i cant imagine any permit granting a right to string up lines to exclude people from using public trust lands/waters. I loitered there today. Didn’t fish as I had plans elsewhere. But I stopped and loitered a bit just to spite 'em.

I was contracted to do an event at Agru, the new owner of the property and tipple, this week and spoke with a gentleman there. I brought up that some folks were asking questions about the tipple. He said, if you are looking at the tipple, that they own it and everything to the rock wall about a couple hundred yards away to the right. He said the left side, the shallow side, was not theirs. He mentioned that they don’t want people in their boats because they will be storing these massive water pipes in the water and they have to follow “International Trade Laws”. I believe “liability” was mentioned and said they planned to renovate it in due time.

One, I am not sure what International Laws they have to abide by. Two, I don’t think they own the water, unless they have asked the state to use that space to store these pipes. Three, those pipes are massive, maybe 10-12ft in diameter, and the section I saw was 200yds long. Be careful if riding around there. He said they were buoyant, so they should be visible, but they are black.

Guess they are worried about small boats getting in the way of loading these huge pipes on ships.
Assume all those stanchions in the river are for holding pipes until they are loaded?

I fished the shallow side yesterday and saw a few small boats right up under the no fishing sign on the other side. Water was very clear and all I could see was pinfish.

I tied up to the posts two days in a row in late Nov…caught 16 over both days and plenty last year including an 8 pounder…Ive had a ton of luck there…really hate this.
