Depends on the fish, whether they are dead or not (in a live well still swimming or on ice) and there attitude at time of contact. If they are out of state they can be placed under arrest at the time of citation and carried to jail until the fine is paid. I know a dead redfish can cost you $1000 per fish. Or you could just follow the rules and enjoy the water like most everyone on this site haha, not saying that you were breaking the rules or planning on breaking the rules. I know you were just placing an inquiry.

The one that caught the fish? If neither angler claims it then both? I knew a few guys several years ago that wouldn’t claim an open beer can, during a license check. They all got tickets for an open container, even the one’s who didn’t drink.

I practice catch and release most of the time. If I keep any they will definately be legal. Guess easy solution is take a small cooler for drinks and put my fish in it.

a friend was fishing around Hilton Head Island and coming back to Savannah the SC DNR stopped them and checked every fish on the boat. He had one that was about 1/8 short and ended up with a $110 fine. The fish would have been legal in 10 minutes when he got into GA waters.

Fish shrink when they get on ice. With fewer officers they are prolly writing more tickets. The few laws left that are just, need to be obeyed. All I can say is that fishing is now like living in California in 1942 if you are Aisian. You should expect to be persecuted. It would be great if our crappy Governor would stand up to the feds, but she sucks, and we all know that ain’t happening.
These threads are stupid. You break the law then pay the fine. Why try to game the system? Tired of the bull of “my fish was in the ice and is shorter now”. When in question just do the right thing.

The situation that the original poster may be getting at is the same situation I’ve been in before— guy in front has a cooler, guy in back has a cooler, two separate bag limits for two separate dinner tables. Guys simply don’t check each other’s creels to make sure they are actually legal. If my fishing pal decides to keep a risky fish, or mistakes the size limit (say, they keep a 14" red by mistake instead of a 15" red), then they’ve broken the law but the other dude doesn’t realize.
Everyone that I’ve fished with this summer was keen on the law and followed it, but I’ve been out with guys in the past (esp, in freshwater for largemouth and stripers) that turned out to be daredevils and kept whatever they could fry.
No fish is worth losing your boat, trailer & truck over. If in doubt, release it.

Who could write a ticket for 1/8 inch??? Some bigheaded bully or “a hole”…Intent of the law and intent of the perpetrator should always be considered. If the majority of the fish are over or under then intent was to keep illegal fish(fine for out of state or no license and points for in state).Use common sense.

Take black sea bass for instance. The law says that they have to be 13" long to keep. There are literally millions of them out there that are 15" or better, so why in the world would you have any 13" long fish in your cooler? Doesn’t make sense to me… If they are anywhere close, throw them back!!! It’s really (**() easy…
It’s the whole “I gotta get MINE” attitude that is the reason why we have such tight regulations. You can’t trust fishermen to do the right thing. Hell, if the law on grouper were 1" long, you can bet there would be assholes keeping 3" long grouper. At some point, people should develop a conscience that puts the resource ahead of their own desires…

Me too. There has to be a line somewhere. It’s either legal or it’s not. If you put a short fish in the box and get caught, you are a dumb@ss and deserve the fine. Doesn’t matter if it 1/8" or 8". We have a system here…It may not be perfect, but it sure as h@ll is better than some other places in the world.

Ok <lets put this one to pasture. I always check the size because I can’t afford to give up my hard earned money. I was just curious how that would go if all fish were in one cooler and there was either 1 over or under. Guess I’ll just give up and read all of ya’lls posts.

Also note that for most violations, there is a penalty of “up to 30 days in jail”… I wouldn’t be that tempted to try to piss off a judge… You guys can play “Captain America” if you would like, but I would just pay the fine and sleep in my own bed… I don’t sleep too well in a 6x8 cell on a vinyl matt…
