Was the warning for flares from Dnr or Fish and Wildlife? I had fish and wildlife ask me for flares up there and when I asked him if I was outside the lines of demarcation he said no and that I didn’t really need them where I was but from a safety standpoint I should have them. I’m guessing you were not in an area you needed flares.

SC Department of Natural Resources - officer mentioned something about being in a body of water over 3 miles wide…

It’s not the width of the actual bay that matters, it’s the opening to the open ocean. If the opening of the bay is wider than 2 miles, then you need VDS in the bay.
Charleston Harbor, Key Inlet, Winyah, etc. do not apply. St. Helena Sound, you better have flares or other device if you are beached on the back of Otter Island.
I have also had DNR ask for flares only. When you say no or they are expired, they write a ticket without ever asking for alternate VDS’s.
My dad had a flag on board, and expired flares. They asked for flares, and saw they were expired and wrote a ticket. The whole time my dad is trying to explain to them that 1. he didn’t need flares in that body of water, five fathom creek, and 2, he had a flag which was good for day signaling.
Still got a ticket, went to the hearing and the DNR officer got embarrassed.
Went last night, took a solid 2 hours to cooler with shrimp smaller than opening day, booooo.
