Nice red there, Go Fish.We’d ALL better start being careful about posting pics of fish in the boat that are illegal to possess in Fed waters,though.I don’t personaly think you have done anything wrong here, mind you,but I know that the feds have cracked down on this practice in FLA and it is only a matter of time before they start searching the web looking for easy tix to write around here.We catch a coupla lg reds every year while btm fishing in 65-95ft and post pics of the fish IN the water.That is a very nice pic and I am glad y’all caught it.I’d just hate to see anyone here get a ticket for not really doing anything wrong.I am sure it was a typo and y’all were fishing at the Chas NS(state waters),which is about 6NM off the beach.Right?

NR,I am not sure it is being enforced around here,yet,but the feds and FWC are enforcing it in FLA.Red drum are illegal to possess in fed waters PERIOD.Same as great whites and goliath grouper.If the fish is in the boat,it is being possessed I guess.I just don’t want anyone on this site to be the first to find out the hard way.I sure don’t blame Go Fish for taking a pic.That is a beautiful fish.

Come to think of it I did read something of that in one of the fla magzines that they where doing that. Cant remeber which one but they where talking about this because of the tarpon not allowed to take out of water or something like that.Was coming in one afternoon just got to the habor entrance and dnr pulls me went through the ck and then asks if I we had my hms permit ask why he said had fishing rods for them in boat . told him we where bottom fishing today . I had the permit showed it to him guess its like hunting .Have 12gauge to rabbit hunt in january god forbid theres buckshoot mixed in the bag get you hunting deer out of season.
The only way to actually get busted for this would be for you to pull a fish out of the water within sight of a Federal Agent, right? So, if you’re going to take a red out of the water, look around for any nearshore Federal Agents first.
So they can write tickets based on pictures on the www. If thats the case I know of someone that shot some tamies with a speargun once and posted pics of it on the www.

I’m pretty sure the same fed rules apply when taking a billfish from the water for pics. Can’t have those sails in the cockpit for pics anymore…and no blues or whites thru the transom door. The feds are trying to let folks know that fish the tournaments…hoping it will filter down the ranks to the everyday angler.
I am going to need a lawyer to keep up with all of these regulations.

I think you’re right about the “Legal Advice”. This forum should provide free legal advice prior to posting any photos for their loyal members. Before you know it, we’ll probably have to have all licenses, a copy of the newspaper with date, and an ichthiologist on board, and show them all in the photo prior to posting.
Who can really keep up with all these regs. It’s not an easy task. As science gets even more accurate, the catching of any fish will be tied to the calendar and their individual mating cycles (like hunting).
The only difference between men and boys is the cost of their toys.
