It' official

I am now officially boatless(except for my canoe) thanks to dernflatlander.:imp: Jim has been threatening me since Sept., that he was going to pick up the boat he loaned me over 3 yrs. ago. And yesterday it finally happened. No matter how much I kicked and screamed, he still hooked it up and took it away from me.:frowning_face:

Seriously, Jim was a great friend to let me use that boat for all these years. I had to sell my little 14’ v-hull and he immediately offered the use of his, since he hadn’t used it for a while. All he asked was for me to build a battery tray for it and mount it under the front deck. His only other request was for me to use it like it was mine.

I just want to thank him publicly for his generosity and his willingness to help someone out.

Thanks Capt. Jim! You sir, are a truly good man.
(Don’t forget about the 200 bucks you owe me.:wink:)

On a side note: Does anyone know if I can legally charge storage fees for a boat left at my house for over 3 years? :smiley::smiley:

Technically (which is just a nice way of saying ā€˜no’), I do not believe you can charge ā€œStorageā€ fees (in the absence of a written contract to the contrary) as Capt. Jim was not under any agreed upon obligation to pay cash in exchange for storage …

The only agreement outlined was one that falls under the doctrine of ā€œQuid Pro Quoā€ (you build battery tray and you can use my boat) with a qualifier (you can use my boat so long as you treat my boat as well as you would treat your own) …

As there was never any ā€œMeeting of the Mindsā€ as to any additional services and/or fees, your chances of collection are negligible … :wink:

On a side note: 3 years of exclusive use and possession in exchange for a battery tray appears to be excessive given current market prices for similar services … so unless that battery tray was welded outta 24K Gold I would be a little more concerned about a Capt. Jim bringing a claim against you for price gouging … :smiley: :smiley: :smiley:

Only if you NEVER used it, then it is perfectly acceptable. If you used it, you owe HIM whatever amount you feel is reasonable for 3 year’s use of a boat. :smiley: I’m thinking a minimum of a good steak dinner and a cooler full of beer.

Those fall under punitive damages (punishment for injury (physical, mental, emotional) caused in conjunction with actual loss) …
