Kids count for bag limit

Stupid question but do kids count against your bag limit? That is, can I count my 8 year old and take 5 more black bass?

Yes. As long as they are reasonably old enough to hold a fishing pole they are a person.

The dnr considers any passenger on my boat part of my 6pack license. If toddler counts against my 6 then why shouldn’t they count as another bag limit?

Down here is where a signature goes but they can confuse and anger some people so I don’t have one.

As long as they are under 16, unless like fritz said, you have a blanket license for your charter. If over 16 they have to have a license to use with bag limits.

What you describe is completely legal although I will tell you retaining bag limits for very young children is one of the things that led to the boat limit for flounder and other species. Back in the day it was not unusual to encounter a gigging party in the middle of the night with infants or children age 2-4 asleep in the boat in order to retain their limit which at the time was 20 per person.

I’d say anyone that actually did that, probably needed the fish to help them survive.

Might not have been unusual to encounter this, but it was also very rare. Honestly, have you personally encountered this? Or just heard it happened?

Just know this, If my wife is fishing with me and catches 6 nice keeper spot tail and I catch none. We are going home with 6 fish for supper and the rest put up for later. If she caught 9 and had our daughter with us, we would bring home 9.

To put the above in perspective, my wife only fishes with me once every couple of years. Darn straight we are gonna take advantage what we can legally keep.

I used to do that just because I didn’t have anybody else to watch the kid:smiley: Never counted him for in a limit until he was old enough to stick a fish though.

This was topic addressed by the DNR at a presentation they gave at a Midlands Striper Club meeting a few years ago.
The creel limit applies to the actual angler not the number of persons/anglers on the boat. In other words you cannot apply the fish you catch to the creel limit of someone else.
If your eight year old is the one who actually catches the fish then you are OK but you cannot catch 10 fish and apply 5 to him/her just because they happen to be on the boat.

Exactly. It would come down to a matter of proof. Granted, I’m a bit of a boy scout when it comes to rule and regs and therefore never look to bend the rules but the burden of proof would fall on the officer and this one probably wouldn’t come out in his favor.

In the future, where every stranger poses a potential threat, knowing the predator mindset is the only safe haven.

Like I said, if the wife and I were fishing and I caught no spot tail and she caught 6, we would go home with six.

I was responding to the question as to whether he himself could catch and keep 5 additional fish if his eight year old were with him. Legally speaking the answer would be no. I totally agree that in reality he would most likely get away with it.

My 8 year old almost always catches more fish than I do! I’m serious about that. It’s a little depressing but I bury that deep down.
