I got this dock spotted for possible sheeshead fishing, but a big No Tresspassing sign is on the dock. I don’t want to get up on their dock, I just want to fish underneath it. Can I do that? It’s a commercial dock.

as far as i know, as long as you are not on the dock or tied up to the dock, you can fish anywhere around/under it.

Depends on where the dock is. The Commercial Docks on the Cooper near the old Navy Base have a 150’ buffer zone and you are not allowed within 150’ of any of those docks. CPD and CSO have thier boats near the CG and NOAA Piers and will run you off and can cite you.

I do not think the owner cares about people fishing under the dock.Do it and see what happens.Just make sure you have health insurance.LOL

Yeah just dont touch any part of their dock and make sure when you run out of fiddlers you dont use their dock as a path to the marsh to get more. TR is right too Ive been run off by the cops a few time from those docks near shipyard creek… Big tickets ive heard of, I was fortunate they told us to move on and read the sign next time
Please show me the state law that authorizes local law enforcement to erect signs and enforce a “no fishing or boating with in 75’ of pier” around PRIVATE piers? I have always given the SPA, navy base, and fuel piers a wide berth, but the bulk cargo and other civilian piers have been fished for ever. The Amoco pier up by Bushy park has boats around it all the time. It seems to me that Chas County has found a new cash machine in the form of local fisherman. What difference is a homeowner on Horlbeck or Hobcaw creek putting up the same sign? would the Sheriffs dept enforce the same 75’? It has always been my understanding that you have rights up to the high water mark, and as far as fishing around a pier (other than a security interest) the water is public domain , unless the Cmdr of the port (USCG) places an exclusion area around it. Have any of you attorneys looked into this? I plan on taking them to court with a jury trial and subpoena the CMDR of the port if I am issued a ticket. i am sure it is a matter of time till I am written up. I still want to know how much enforcement they do running up and down the cooper at 50+ in those shiny Contenders! hey guys…you need gold chains!

private or not, if they are protected under “homeland security” rules for protecting the port, they can run you off. thats teh difference between Hobcaw, and shipyard. Not sure which docks fall under that category, and who makes that decision, thats above my pay grade.

Sells, if a dock is listed as “critical infrastructure” and covered under Homeland Security, it isn’t a state law but a federal law. Although some states have adopted similar statutes. Too many players in that arena to be able to easily narrow it down as to who has jurisdiction. But Customs and Border Protection, Coast Guard, ICE and the FBI are all charged with Homeland Security duties. I don’t know how much effort they would put into something like this, but I wouldn’t want to be the lab rat they decided to use as an example to send a message to other potential violators.

how much “critical infrastructure” is the outflow pipe at Westvaco? they have put up a sign at the best place to catch bait on the Cooper. I don’t think that Hajee and his buddies are going to blow it up. But this spot has been important to fisherman for over 20 years. CG and DNR do not enforce these idiotic signs. It is the Contender cowboys from the sheriff’s river patrol. When the CMDR of the Port deems something as a security area, He puts an exclusion area around it. Like I said before, not looking to fish around the subs on the WPNS station, SPA, or passenger terminal. But when people get written up for being NEAR a pier on shipyard creek (commercial bulk goods) or at the outflow pipe at westvaco, or any of the other old piers on the Cooper…it is wrong! chalk it up as a win for the other side…one more freedom taken away.

Can’t answer that one Paul. Wish I could. Personal opinion is maybe they don’t want anyone getting access to the water coming directly from the plant. Maybe prevent the enviro-nazis from finding out what they are really dumping in the water. I truly have no idea.
As for commercial docks, imagine this. You and a few buddies want to smuggle in a weapon of mass destruction/effect or whatever. But you have to get it off the ship before CBP can examine the cargo. So you have a buddy pose as a fisherman near the docks. A package get dropped to the boater and away he goes into the various creeks and rivers that run all over the place here. Hence the 150’ buffer.
While you and I would’nt do that nor would anybody else that is on here. But how do you know who is in that boat up near the dock?

At one time N. Charleston police had a contract for enforcing Homeland Security and stuff. I saw 5 of them putting in at Wahoo one time, and one cop boat tried to bust someone in a jonboat 15 ft of the dock. Like you say, most of the time they just roar around, burning fuel and stopping fishermen and talking tough. Probably on overtime, it was the week-end.

It’s happening everywhere! Just try to fish inside the buoys around the dam on Moultrie. I have had SLED out there many times watching me like a hawk. I think I would probably fit the bubba profile moreso than an arab one. Just cuz I chant Allah doesn’t mean anything…[:0]
Just the other night, Long Enuff and I were a good bit outside the buoys casting a jig toward the end of the finger pier. I noticed a guard over 3/4 of the way to the end. She was watching us closely. I finally waved and asked her how she was doing. She said that she would have a great night if we quit casting over the line. I realize that they are just doing what they are ordered, but they could use some tact. The whole rule is BS! I mean, I can go in there and catch bait all night long, but as soon as I drop a plug, I am a threat to HS… I am just sick(like all here) of our freedoms being taking away because of terrorists.
