Can someone enlighten me and help me understand why the rec. harvest closes in two days, but the commercial is still open?

Now, how they get “recreational harvest statistics” for porgy is a mystery…
It isn’t a mystery to me. Makes perfect sense how something so ridiculous could happen.
Magnuson-Stevens (federal fisheries management law that governs these fish, and many others) was amended by folks who wanted there to be hard deadlines and bright lines for the NMFS and regional councils to follow. Some of these folks were paid by seafood importers. Some of these folks were paid by ship builders who benefit from consolidation of fleets towards a few larger vessels. Some of these folks represented groups who wanted to put small domestic seafood harvesters out of business. Some groups claimed to be advocates for sportsmen. Some represented two or more of the above groups at once…
In the mean time, as they like to do, environmental groups swept up the credit, which was left behind by lobbyists who were more interested in $$$ and new jobs with various entities than grabbing more credit than needed for the aforementioned goals, and dumped it into their crowns of jewels for all their unknowing benefactors to enjoy.
What all of these folks, perhaps intentionally in some cases, failed to allow for in their, self-proclaimed, brilliant championing of fisheries management policies is that NOAA and NMFS would chose to spend half its budget on catch shares propaganda in an attempt to ensure themselves a steady stream of income when Congress slashes the NMFS budget upon realization that 90% of the fisheries NMFS has been claiming were in crisis have actually long been rebuilt. It does not behoove NMFS to perform thorough stock assessments for what it manages at this point in time, you see, because that would not be self-preservation of bureaucracy. They benefit from there being a need for closures. They benefit from there being a perceived crisis. They benefit from pursuing other goals instead of improving and implementing accurate recreational catch reporting for more realistic fishery management like Congress TOLD THEM TO DO.
They follow the parts of the law on an “as funded basis,” you know…

New Gov’t Employee; Hey boss, I just spoke to your friend at PEW…He wanted to know if we were working on the latest species closure(Porgy). I told him the fisheries were looking great but we need a new stock assessment to justify any further closures. They have no idea if I have caught one porgy or one million porgies (bycatch). My problem is that they have no idea what the hell is actually happening in their large fishing bubble, but they act as if they know exactly. I have gotten riled up about similar situations and closures and have had some angry heart to heart talks with Kim Iverson with SAMFC. She of course pushes the blame to NMFS and states that the SAMFC is just the spokesperson for what the NMFS rules. Personally, I don’t care either way. If you make a statement, own the dam statement.
On a calmer note, where do the rec. porgy numbers come from? “End of the rainbow” possibly? “Mid-air” probably.

In November 2011, the Southeast Region developed a Saltwater Recreational Fishing Action Agenda to complement the National Saltwater Recreational Fisheries Action Agenda. Both action agendas will be updated periodically through coordination with recreational stakeholders.
The current goals in the Action Agenda are to:

?Improve recreational catch, effort, and abundance data;
?Improve social and economic data on recreational fisheries;
?Foster communication with recreational fishermen; and,
?Promote understanding of the fisheries management process.
In addition, the Southeast Region supports conservation efforts, including reducing the impact of marine recreational fishing on protected species and marine habitat and by providing public outreach and education on marine conservation

I would venture to say that 80% or more of their assumptions their ACL for the porgy complex is based on historical headboat data. That is the best recreational data they have. Now think about what it means if you are predicting a population of wildlife based on its historical capture rates from such a sector.
As capture rates decrease in said sector, due to the sector essentially dying off, your conclusion, given the vacuum of data allowed/forced by law now, will be that the population must be decreasing.
NMFS was supposed to develop a comprehensive recreational survey system to replace the old broken system. Like I said though, they don’t want that. They don’t want to show the true state of most of the fisheries they manage.
Follow the money. This one’s simple since these fish don’t have much economic value to anyone. Who cares if the assessments are right and the ACL really is related to maximum sustainable yield or not? Who cares if the bycatch mortality rates are right or wrong? T
