I stumbled across this on the SAFMC website today. Does it mean that BSB are open all year in federal waters if the quota isn’t met?

The recreational BSB season will remain open until the council scientists guess the quota has been landed. These guesses have proven to be off by over 70% in some cases.
Are state waters exempt from the ACL?
No, all BSB landed are counted against the ACL. A closure in federal waters also makes it illegal to keep that species in state waters.
Striped bass have been banned if fed waters for years but can still be kept in state waters so why is it different for sea bass??
Just asking?
Jeff
I think Striped Bass are only illegal for commercial harvest in federal waters.
It is illegal to land or target striped bass in federal waters due to an executive order by the GWB admin that declared them off limits to both rec and comm anglers
Sea Bass are off limits due to an order from NOAA fisheries but SC passed a law keeping them open in state waters. NC will mirror the feds rules and close when comrades cupka and crabtree say to close it.
That being said, even though SC will remain open it will be closed for anyone holding a federal permit (charters, head boats) and the landings will be counted against the overall catch limit that the feds set, even though they are landed in state waters.
I think that is it anyway…

…if you believe they are actually counting. And a closure in federal waters doesn’t make it illegal in SC state waters. My bill was just passed this year allowing open season on BSB in state waters.
