There is a pic of Seth and myself in this months fishn & huntn magazine. Its says customers catching nice fish with such n such guide service…I have never used a guide and think it is wrong to say we did on fish that me and my partners (steelytom was with us that day as well) work hard at to catch. That was a tough day and to give credit somewhere else is wrong. I USED to buy some bait periodically there. I no longer will.
I will say I sent him the pic but not to say we fished with them. It may be a misunderstanding and the magazine just wanted pics and they just wrote what they wanted.
I may just be whinning, over spilled milk but I think its my right to do so.

When you say you won’t by bait there again what do you mean. I think you mean the place you got bait also runs a guide service or do you mean you won’t buy bait from the place you sent the picture. Is that correct?
I’m sure it was just a misunderstanding. The guides catch enough fish that they can just use one of their own pics. Probably intended to say photo provided by or got bait from or something like that.
I do not think this magazine does much to check sources. When I caught my 50 lb’er they took a photo off of the bulletin board at Sportsman’s Warehouse and posted it in the magazine as “unknown” angler catches nice fish, or something to that effect.
I’ll admit it was a knee jerk reaction. I am over it now…lol… it really caught me off guard when I got a text from a fellow fisherman wanting to know when I started taking guided trips.ha. I will say it was not any local shop/guide.
but anyways time to go ice the boat down for grouper hunting in the morning…

Kindly point out to them that you are the owner of that photograph and you have given nobody permission to use it, and respectfully point out that they may owe you royalties. At the very least, a couple years worth of their magazine.
I do not know who the authority you would contact for this violation (really, it’s theft, even though perhaps unintentional), but if you do find out, just make it respectfully clear that you plan on contacting this authority with the proper evidence. Nothing to get upset or angry over, but that you are owed something for your picture being published without permission.

I think a call or an email to the editors should suffice. If Rick had done this or proceeded according to law when it first happened to him , hopefully this could’ve been different for Murray. I tend to believe in people and give them a chance before assuming bad intentions.

As I understand it from many years in the printing business, whomever took the picture is the owner and can control it’s use. If you or your family, friend , etc. took the picture then you do have rights to it as stated above. If the guy who sent it in took it then he has the rights to the picture. If he stated that his service guided you and that’s untrue then someone could be in a lot of trouble. Hopefully it’s all been a big misunderstanding and a phone call can resolve it to your satisfaction. Good luck.
