The “Management” does not have the autority to grant permission of use for something it doesnt own…plain and simple.
Having a note on a piece of property has nothing to do with ownership…could management give you a key to one of the condos and give you permission to use the condo this weekend because Dick and Jane are out of town until next week??

actually you are wrong again. South Carolina is a lien theory state, not a title theory state. The owner of the condo, even if he has a mortgage on it, still retains the deed for the condo during the loan term. The mortgage becomes a lien against the property and is removed at sale repayment or at payoff but the title remains with the buyer. So technically, the bank doesn’t own the condo in SC, the borrower does with a lien to repay.
Either way, it doesnt matter because the management company doesn’t own any of the units. They are hired by the owners so you were given permission to do something by someone without the authority to do so. The same thing applies as the guy said above. The management company can’t give you permission to stay in a unit either.

Here’s my side… I was given permission to fish by someone I THOUGHT had the authority. Turns out they didn’t. I left the dock, PEACEFULLY. I have not returned. I do not intend on returning. I SIMPLY THOUGHT I was given permission by someone who had the authority to grant it. I did nothing wrong. I’m not now, nor have I ever trespassed. I wanted opinions as to whether I was in the right or the wrong by using - what I thought - was a privilege granted to me and ended up on the receiving end of bitter property owners who have been taken advantage of. I understand everyones point and have agreed with those who see my point and even those who oppose it. The thread has pretty much run it’s course. The original post wondered if he should be “bitter” at the gun that supposedly ran him and his kid off.
I do not think you should feel bitter. Disappointed, mad maybe, but that’s about it. Whether you did or didn’t have everyone’s permission, you and your child were there as guests. No matter how many times prior or whatever the former circumstances. Guest privileges can and often are subject to change and revoking for little or no reasons. Some of the posters (Palmetto Bug, et. al) have raised some very salient points.
My neighbor and I share a dock. Each have a floating dock on a tidal creek. The docks have a long walkway (over 500’) It is just about the nicest place in the lowcountry. Just beautiful
You can’t imagine the number of people that trespass on my dock. My neighbor had his kicker motor stolen a month ago. Runners, just extending their run, local walkers, people in the neighborhood. Some of the neighbors have allowed their little kids out there without supervision. There’s a hell of a current when the tide is falling!!
When I go to see what they are doing, they ask…Is this your dock? It sure is nice out here! etc etc.
What they don’t seem to consider is they are essentially trespassing in my back. I live in one of the nicest and most expensive neighborhoods in the area. So the point is, it doesn’t take unwashed masses to take advantage of private property rights. And, of course, I’m a real bad guy if I run off the neighborhood kids. I’ve had to put up ugly no trespassing signs on my own property just as a pre-emptive liability act.
Anyway, my contribution is this. Don’t make private property owners the bad guys for asserting rights and responsibility over their own property. Even if you are “just fishing with a little kid.”

THE PROPERTY OWNERS! Not a management company…they manage the facilities that someone else owns…hence the reason they are called “MANAGEMENT” companies instead of “OWNERSHIP” companies!

Dustin, I think that you maybe misunderstanding what some of us were saying. I think it is great you are taking your kids fishing. I understand that someone gave you permission to fish that you thought had the authority to do so and thought you were not trespassing. I dont think you were doing anything wrong. I dont think anyone thinks you are a criminal, a low life, etc.
The only thing I was trying to point out was that you got upset that you got asked to leave a private dock by a property owner and you came on here and asked what type of lowlife would do that. All I was trying to say was, he ins’t a lowlife and you really don’t have any grounds to be upset on. Nothing you did was your fault but you cant get mad when people who own private property ask someone who has no right to be there to leave. You did not know that you were not supposed to be there. You thought it was ok for you to be there because someone that should not have given you access to the place did. When you found out that you were not supposed to be there and got asked to leave, I am sure you were pissed and embarrassed, which in understandable.
All most of us were trying to do was just point out facts of the situation. It doesn’t make the guy that asked you to leave a snotty rich guy or a mean person. It is just simply his place and not yours. He has ever right to ask you to leave, just as you would if someone showed up on your property. I think you are trying to separate the two because this is a condo area with common areas instead of a single family home. It is his personal right. You wouldn’t just walk out of some guys dock where you friend cut the grass without the owners permission right? This is the same thing. The management company takes care of cutting the grass, among other things.
