Gentleman,
We now live in a police state, and its time to get used to the fact that regardless of your experience, our DNR has overstepped their bounds. I know a young man who I have done business with, and fished with numerous times over the last 15 years. I speak with him at least once per week, down from once per day, but continue to value his opinion on everything from politics to swordfish rigs. This man is honest, dependable, and an over 20 year USCG licensed captain. He is well regarded in the fishing business, and was unfortunately having a good time this past weekend at the Beaufort Water Festival. Being stopped by a DNR officer for a routine check is no big deal, or so he thought. Having many friends in green jeans, he answered honestly in that the long ride from his home port, he had 2 beers in 5 hours - what a big mistake. He was then asked to take a breathalyzer, of which he willingly took and passed with a 0.0. Thats correct… O.0. However, the officers had enough “probable cause” to take him to the hospital and ask for a urine sample, which was also agreed to by this man. After this, they hauled him to jail, while the ranking officer at the Bft Water Fest (and one of his former clients and “friends”) WATCHED IT HAPPEN. Having known his background, do not ever think that common sense and reasoning have anything to do with the fact that our government officials can, and will do whatever they wish to whomever they wish, at any given time with ZERO consequences. NEVER give a law enforcement officer a chance to take advantage of you, because the number of bad apples has increased and your chances of being given any leeway in a situation such as this are ZERO. Having been a structured man my entire life, and one who welcomed a presence of safety in our waters, I am through with DNR.
Reason I guit going yrs ago. Policing is needed but not to the point they take it! Soon there will be so few people going and then the County/city will suffer the economic losses. Then I bet we won’t see near the presents. Drunks deserve the conquences, but this is a perfect case of BS! Stay away from the BWF!!!

I’m sure that’s also the first time the officer ever heard " I’ve only had 2 beers all day"!!!
You usually don’t go to jail for being a sober boater and a boater’s background doesn’t get him a hallpass to bui.
Lesson learned, lie to the man!

Was he under the influence of any prescription or illegal drugs?
That sounds like something out of the norm…? I’ve never seen DNR do something this drastic unless the individual was being a smart a** , not saying your friend was… but was he? Sugar goes much further than sh#t with our law enforcement agency. Those guys get to see a bunch of jerks on the water during the Beaufort water festival seems strange they would target your friend with a 0.0 reading with no other cause. Just saying.

maybe the breath machine was not functioning properly, and they went to plan B
Never submit to any tests. Dont answer their questions. Be respectful. Call you lawyer from jail.
Ive never seen as many DNR before as there were saturday out there.

In 25 years of being a Officer of the law. I have only seen a couple of Officers I would have called bad. Most hate paper work to much to just make a case that they can not win. So I do not think it is a conspiracy. Most are just out there trying to do the job they were hired to do. I was not there when this happened. I can not say it was wrong or right. But to lump all togeather as bad is no more fair Than what you believe was done to your Friend.
I hope your friend finds Justice which everway it goes.

What was he charged with?

I have been to a few BWF including last Saturday. I was surprised that I only saw one LEO. We came in from Savannah and last year we had the CG and maybe 5 to 6 DNR boats pass us.
I was more worried about the no wake zone from Port Royal bridge to downtown. That is where we saw the DNR and LEO last year.

Ok, maybe I missed something in this thread. I obviously wasn’t there but if he was arrested for BUI after the urine test at the hospital, his BAC was clearly over the limit. So what exactly is the gripe? If the original poster is upset with the fact that the field unit registered 0.00, it could have been that the tester was defective or the captain was being uncooperative and not blowing as instructed. Either way if he was over the limit, he was over the limit and deserved to be arrested.

Crab, are you an idiot son? What did my post say? 0.0 - sober. Urine sample last seen was on the seat of a HWP officer’s car that took him to jail. This entire situation is ridiculous. Chisolm Frampton should lose his job for being an a$$hole and using poor judgement. Do not trust anybody in a situation like this.

OldSchool, we were there as well. We counted 14 DNR boats and 2 Beaufort Deputy boats. We watched the air show from deep water not the sand bar. The deputies rode by and spoke with us several times and were extremely cordial as we offered water and Gatorade. The DNR – well not so much. We took pictures of those that wouldnt wave back to us. I think we have pics of @ 14 different DNR vessels
I also heard @ your buddy. I heard he passed all pee test and blood test @ 0.0. My understanding is once they decide to ask you to submit to a breathalyzer or blood test you are done. They are just looking for evidence. Even if you pass @ 0.0 your evening is ruined. You will not be released as Crabjack suggested.
I cannot speak for this year but have had friends (Beaufort Local) in a previous meeting that refused to work as volunteers (recognized group intentionally omitted) because of the tone set by DNR agenda. You most likely know at least one of them. Call me I will give you their names as well as some interesting quotes from this particular meeting.
I hope the situation is remedied.
If I were a betting man, a person with that name was probably picked on as a child.
Just sayin’…

I wouldnt even say something like that,I respect what our men do for our natural resources.
I believe a bui crackdown was put in place after last summer.Still, there have been 2 bad accidents involving alchohol. The one accident on the lake, the driver drove a bass boat head on into a dock. The man and the woman were so pickled, they never even knew they died. The other vessel was driven into a daymarker in the harbor, driver charged with bui, they were extremely lucky.I think both accidents were before the BWF.
So,if you dont like how SCDNR handles those who have been drinking,or suspected of drinking, dont fricking go on the water.
Old school,you owe Mr.Frampton an apology,sir.
