I’m with you Bigfisher, been in LE for 24+ years and have seen a few “bad” cops. Most are simply trying to do a tough and often thankless job. It always disappoints me when folks are willing to malign an entire occupation because of the actions of a few. I guess it is easy to dismiss all the good the men and women of LE do each and every day. I have several friends that work at DNR and they are doing a tough job with limited resources (their budget has been cut nearly 50% over the last 5 years). Are there jerks at DNR? Yep, just like there are jerks everywhere else.
As for the above situation, I was not there so I don’t really have any comment except that if he is guilty he should be punished if not, then I hope justice prevails and he is exonerated.
It has always been interesting to me how alot of the public complain about Law Enforcement Officers doing their job and then complain about them not doing their job. So don’t be surprised when you meet many LEOs who are a bit standoffish or guarded in their interaction with the public. It is a thankless job.

Ok, think for a minute. Imagine if no DNR officers existed, would you even go out on the water. I respect the job DNR does, I have been checked and assisted by them a number of times over the years and all acted professionally. I suggest withholding judgement until ALL the facts are known. I have come to realize that most folks who have a problem with LE are folks who like to draw outside the lines.
Yep, I would go on the water in a heartbeat. I do not believe in a “nanny” state.
All I can say is make sure your friend gets a good lawyer. Even if he blew 0.0 DNR I believe still has a the authority to take him in. Don’t take my word on it though. It might not be right, but does happen from time to time. Any good law man should be able to contest this and maybe get reimbursed.

Forgot to say that in most laws dealing with alcohol, is that if they did not get a blood sample then they could be screwed with trying to prosecute him. Especially with a 0.0 on a breath test. Blood does not lie.

Ok,for the sake of arguement, there is no LE on the water, it seems BesTimes would just be as happy as a clam to take his family/friends out into waterways. Apparently, he has never seen the young kids carrying the coolers of beer, etc. onto boats like I have. They do this with LE out there, imagine just for a minute how much they and others would take and consume if they had no fear of LE keeping things in line. It would be extrememly dangerous, I could see many deaths associated with that way of thinking and lawlessness. I for one do not want to worry about policing it myself, we have laws and officers for a reason, and they are the right reasons. If the guy who had the run in with DNR at the start of this thread is truly innocent - he’ll have his day in court. I wish him well, I am confident the truth will come out in the end.

Just to clarify my post.
A) Field BAC testers cannot be used convict nor exonerate a suspect. Field testers are but one tool a LEO has in determining probable cause.
B) You never stated whether he passed or failed the urine test. The fact that your friend was taken to jail after the test was administered indicates to me that he either failed the test or he was charged with something else. I asked what he was charged with but you never replied. Another poster indicated that the charge was BUI. If that poster was incorrect, I apologize for the assumption.

Indicating what? They never tested the urine? The sample disappeared? You never heard the results? Again kind of vague.
At an event such as the Water Festival there is no shortage of drunks and/or dis-orderlies to arrest. I find it hard to believe a DNR officer is simply going to randomly pick someone out of the crowd and invent a reason to arrest him.
All I’m saying is I would like to hear the whole story before drawing any conclusions. If that makes me an idiot, so be it.

Bui for the second time , and to clarify they gave hime the urine test because they,threatned to take his boating rights for six months if he did not comply, so he said no problem went and did urine test at local hospital and still hasn’t got results
“threatened to take away his boating rights” I havent heard of that, but that is another load of crap if its true.
I have read all of this with great interest. I have no friends or family in the law enforcement of any variety. When I hear about incidences like this, it reaffirms my decison many years ago not to be a boating participant in events like the BFW, Rockville Regata, etc. I have been a boat owner in the Charleston area for 20+ years. I generally don’t drink when I boat. I get checked while fishing at least a couple of times a year by the DNR and have never had a problem because all of of gear, etc. is in perfect working order 100% of the time. I would love to go out and have a few beers and enjoy the crowd at these types of events, but it’s just not worth the risk anymore. I feel like we live in a police state sometimes as well, but I know 99% of law enforcment are men and women just trying to keep the peace and do their jobs.

OldSchool and IM4USC. As a teenager I had friends that knew/went to school with the DNR officer in question(then a teenager himself). Yes, OldSchool your assessment of him is exactly what my friends said about him in the early '80’s, and yes IM4USC,he did have a lot of people “change” his name in funny ways.

Its people like OldSchool who are the first to call and complain when this “Police State” is not policing enough for his/her liking, but the minute it steps on their or their friends toes b/c they were breaking the law they want to complain and put down the people who should be all of our heros!
