well it sounds like they suspected drug use other wise they would not of asked for an urine sample if they thought the machine was broken they would have asked for a blood sample so please post the out come of the urine sample it would be very helpful in this situation.

I got pulled twice on Saturday (the second weekend) with my wife and brother in law and his girlfriend. The first was up in St. Helena sound as we were coming back from fishing. My brother in law is a police officer and he was wearing his badge and a gun. DNR pulls us for a ‘safety check’ and he informs them he is carrying a firearm (which is obviously on his hip, next to his badge). DNR asks if he has a concealed carry permit for the gun.

Yeah.

  1. He is a law enforcement officer, he doesn’t need a permit.
  2. We were fishing, he doesn’t need a permit.

Then before we could get back home we got hit again between the bridges by the sand bar. Got a warning for negligent operation because I was sitting on the bow while the wife was idling past the sand bar as we cut through to get back to the marina. They claim it would have been a $490 ticket.

Last year during water festival, a week after I had purchased my boat, we had run out of fuel right by the marina (turns out the gauge stops at 1/4, now I know). There were two DNR boats under the bridge tied together just hanging out maybe 1000 yards away from us. We radio, we light flares, my father in law (also an LEO) fires off his GUN, I’m standing on the bow waving an orange paddle. Nothing, no movement for a good 45 minutes. They finally come up and we ask if they were monitoring 16 because we were calling them. Guy laughs and says ‘of course’, as he looks up at his radio, does a double take, THEN TURNS THE KNOB TO TURN IT ON.

I don’t mean to be a dick, obviously I have family (well, in laws) in law enforcement, I know its not an easy job, but come on.

You need probable cause to take someone into custody. If you don’t have probable cause, the charge (if any), will be overturned. Every once in a while there is a bad apple, but cops don’t typically take people into custody based on a “hunch.”

The standard for probable cause is pretty high and cops are very familar with the standard. I suspect there is more to this story. If not, then your friend did not get charged and suffered only an inconvenience. A small price to pay in order to keep our waterways and streets safe.

I quite going to these types of events years ago because of these scenarios.

I think this is rather odd. I had a similar situation with the Police in Shelby NC. I was within legal limit but was put in jail with a bond of $1000. They said I was from out of state and that was the problem. After a few grand in lawyer fees walked away. I think our judicial system is a money game. Thats all.

Now with this guy. The hospital does not do a urine alcohol. They do a blood Ethanol level and its pretty sensitive. However, 2 beer over 5 hours plus the time to get to the hospital would probably show no Ethanol in the system. It looks like there is way more to the story than was told to you. Maybe he was acting a fool. I know there are many folks at the IOP (not Isle of Palms) with similar conditions which could lead an officer to do such things.

I still have respect for DNR. Not Shelby NC police though.

Name of adam I can understand why everybody is saying there must be more to the story, or that he must of been acting up. I would have been. But if any of you people knew this man that we are talking about you would know that was definitely not the case if anything he was probably very inviting about pulling over and talking to them and all of there test. I have a strong feeling that all of this will be dropped in court but what does a human being get for there inconvenience, if the site was on the other hand and a person made a mistake would they drop it???

if you really feel that being arrested and taken to jail is a minor inconvience and is a small price to pay to keep us safe- then i really hope you and your wife and all your friends go to jail every time you hit the water. you might change your tune after it happens to you.

it’s sad to say but you need to FEAR any police interaction these days. plenty of innocents in jail, lots of rights being abused, lots of beatings and taseing and even killings and all in the name of " public safety"

If there is no (**()ing evidence to support DNR’s position in this case, who is responsible for accountability? Does the individual have any recourse? Is a civil rights issue in play?

I have seen where these cases have been dropped after the inconvenience of an arrest and an unexpected sleepover. I have yet to see where an individual pursues the injustice and holds the department accountable. My assumption is there is no pursuit because they are glad its over and/or do not have the time or finances to move forward. Ill bet the department knows this as well and operates in the grey areas just a bit on these festival type events.

Heard about this incident from a friend. The explantions was he already been processed for the arrest and that is why he had to spend the night in jail, regardless of the outcome of their “tests”.
Law enforcment requires use of good judgement, clearly that a-hole had none, and he should never be allowed to have any authority again.

I can’t believe some of you think being harassed and arrested for NO REASON is only an inconvenience. This is f’ing America!

I agree with Adam for the most part. law enforcement is generally interested in “helping” people only if they can write a ticket that will generate $.

Dang, you figured us out, we only want to help you if we can make money. You are brilliant. What will we do now that our secret is out?

A few bad apples will fall from every tree now and then! No need to trash the whole crop cause of it.

Just think if LEO’s weren’t out there or anywhere? Even scarier then occasionaly biteting into a bad apple.

Thats pretty funny freedom. People act like they are giving us the money. Lord knows, I have never got any of my share. I have given them 2X the hours I have gotten paid for.
When I get my fill of dealing with people who only think of there selfs. They do things that make me think how could a human think it is alright to endanger someone else for there own PLEASURE or GREED! Theres always that one someone that comes along and does the right thing. Thats what has kept me in law enforcment 25 years. Theres always going to be times when officers make decisions that are not perfect. Most decisions have to be made in a few seconds. Everyone else is given days or even weeks to second guess that decision. BUT let somthing bad happen to someone the first thing someone is going to say is “where were the Police drinking coffee some where”. I wish this was a world where everyone did what is right and there were no need for law enforcment. But it’s not! I just attended the funeral of a co worker a 29 year old kid with 2 small children. He just came out of the Police Academy 6 months ago. He was shot trying to protect the lives of other people most of them he did not even know. How many of you would do that for $30,000. a year.

Do not join the force and b!tch about the pay…everybody knew that going in. Would I do it for 30k?? Not on your life! Nobody joins the police/fire/military for the financial rewards…some of them join for the simple reason that they feel it is the only vehicle by which they can gain some semblance of respect! I know plenty that are great down to earth folks and i also know plenty that think their badge is a crown…

And a lot of LEOS’s join because they truly want to make a difference in thier community and life, regardless of the pay scale. Not all, but a lot I believe fall into this catagory. I’ve talked with many DNR officers around in different states and the majority of them are avid outdoorsmen and women and never want to see the natural resources taken advantage of by select few individuals, hence thier reason for doing what they do, I try to allways thank any LEO I run across for the job they do, even the Sherrif who gave me a ticket a few years back for running a stop sign I didn’t see, I was a nuisance to other traffic in running it and could have possibly caused a accident hurting others, not just myself, so I was well deserved to get cited and told the officer so.
After he gave me the ticket I thanked him sincerally and he kind of gave me a funny look then said that was the first time he had been thanked for giving someone a ticket!
