And was told it is South Carolina state law that any child under the age of 13 needs to have on a life jacket while underway. I was always under the impression that only applied to boats under 16 feet in length. By reading the laws in the South Carolina rules and regulations, the way I read them I am correct in my opinion. I didn’t argue with the coasties because there are two types of people you don’t argue with, Officers of the Law and women.
Personal Flotation Devices (PFDs) - - All boats must have a U.S. Coast Guard approved wearable type PFD for each person on board or being towed. Each PFD must be in good condition, readily available and the proper size for the intended wearer. In addition, boats 16 feet in length or longer must carry a Type IV throwable device. In South Carolina, any person under twelve years of age must wear a U.S. Coast Guard approved Type I, II, III, or V PFD when on board a class “A” (less than 16 ft. long) boat.
Fritz…I went and checked the CFR (I’m assuming you were on a charter)and nothing in the fed code says anything about age…BUT I’ll also bet the CG never checked for your license/typeI’s/all the paperwork we are supposed to carry…did they even ask for the TWIC card we were made to get? And if did they just look at it or did they actually have the card reader?..
Last time I was boarded was in Va Beach and was asked if I’ve ever taken a boating safety course? Told the CG politely, I have a USCG Masters license and got a very nice reply…whats that?
right hand does not know what the left hand is doing
I make my Cherubs (15 & 12) wear their pfd’s all the time and since they gotta wear 'em, we keep ours on too. I remember when I started wearing seat belts all the time…it was annoying at first…

Yea, my 4 year old puts on her life jacket when she gets out of the car at the ramp and it doesn’t come off till we get back in the car. I just feel better when she has it on. If she falls in at least she will float…
I can see from a safety point of view having kids wear them. But I didn’t think it was “South Carolina State Law” that all kids wear them while underway.
There is nothing in the grammar of the sentence addressing age that makes it subordinate to the one regarding boat length. They are separate and distinct thoughts grammatically. Ergo, separate and distinct requirements.

i will be on the water this weekend with a 4 year old and an 11 and a 12 year old on a 19’ cc. the 4 year old is a no brainer to wear one and my son the 11 year old always wears his til we get to the beach or sandbar. my question if the 12 year old balks about wearing one and his parents say it is ok for him not to, by definition of law does he still need to. my opinion ( and it is just that ) he should do the same as my 11 year old just for a being safe standpoint.

amazing how some people try to get around this…I’m the same way…my boat, my rules (anything above what is required by law)…so many accidents happen so quickly you can’t prepare for them…flotsam, sandbar, oyster rake, boat wake, weather and even bikinis have cause accidents…
