Who needs an HMS permit? Been looking around and it’s a little confusing.
Q:Do I need a recreational permit to fish for or land tunas, sharks, swordfish, and/or bilfish?
A:Yes, vessel owners/operators who recreationally fish for or retain regulated Atlantic tunas (bluefin, yellowfin, bigeye, albacore, and skipjack), sharks, swordfish, and billfish in Atlantic Federal waters, including the Gulf of Mexico and the Caribbean Sea, must obtain an HMS Angling category permit or a HMS Charter/Headboat permit. However, General category vessels may fish recreationally for HMS so long as they are participating in a registered recreational HMS tournament and fishing under tournament rules. Vessels fishing exclusively in state waters are required to obtain the HMS Angling permit if they wish to keep their regulated tunas (bluefin, yellowfin, bigeye, skipjack, and albacore). Vessel owners/operators should check their state regulations regarding the retention of sharks, swordfish, and/or billfish in state waters.
AKA- The boat owner must have a permit if any type of tuna/wahoo/billfish or shark outside of 3 mile state waters if being landed. It’s $20 but it does cover the boat and all anglers aboard
You do not need the HMS to keep blackfin tuna.

For $20, I would just get it. Imagine bringing up a tail wrapped billfish and having to leave it for the sharks. Skipjacks aren’t really that uncommon either, and it would hurt more than a little to hit the tuna lottery but have to release a nice yellowfin.

That’s not true. If you fish for the species even to catch and release, you are required to have the HMS. It will be at the discretion of the officer as to your intent. I wouldn’t leave my fate in the hands of any LEO. Just my opinion.
I’ve been stopped by DNR countless times over the years and one thing I’ve learned for certain, is the law is perceived to be different depending on the LEO and their mood at the time.

If your dragging for a hoo, blackfin, or dolphin, you could hook a yellowfin (if we actually had any). So with your interpretation, it is not legal to troll for anything without the HMS. My reading was for a “take”, meaning the fish must be released without removing it from the water unless you have the permit.

Stopped outside the jetties back in the day, caught and released 2 sails and a white that day. No fish on the boat but the rigs on the rods clearly indicated that we were targeting HMS. Got a ticket. We were young and dumb and didn’t even know about the requirement. Get the permit and avoid and much more expensive fine.

Curious to know – what made it so apparent you were targeting HMS rather than any other pelagic species?

I’ve been stopped in the jetties and told them we caught a sailfish but didn’t put him in the boat. It’s tricky tho you can’t target them either… maybe the 34 dolphin we had in the box proved that idk. They climbed aboard and did there thing. I knew the law because the week before I had a guy that was catching his first marlin (white) and wanted a picture. Video showed that we realeased him and he was well. The video is what they went off to track us down. Still not sure how they did that. Paid the fine done deal. Be careful what you post.

Why not just spend the 25 bucks I hate looking over my shoulder all day.You wouldnt go ride in a boat with a shotgun and decoys during duck season without a stamp and try to say you were just riding.
They should do a offshore, inshore and freshwater license and they should cover all permits. Probably could gain a lot more revenue and simplify stuff like this. If it looks in bad shape keep it there is no since in letting it go to die slow. Permits, tags are like gear, better to have it and not use it then need it and not have it.
