Sec. 635.21 Gear operation and deployment restrictions.
(a) All Atlantic HMS fishing gears. (1) An Atlantic HMS harvested
from its management unit that is not retained must be released in a
manner that will ensure maximum probability of survival, but without
removing the fish from the water.
(2) If a billfish is caught by a hook and not retained, the fish
must be released by cutting the line near the hook or by using a
dehooking device, in either case without removing the fish from the
water.

That is what I was looking for. I have spent a great deal of time researching court rulings this morning and have found no recreational fishermen prosecutions that refer to that code, several commercial long liners have meet this fate.
I have been on and off this site reading threads and reports for some time. I chose to respond to this one because of the negative responses to a fellow fishermen’s good catch.
I would rather see a photo op on the stern, then one on the scale.
Probably not the best thread to introduce myself, but what the hay!

gotcha…it was all the excuse I needed to look it up. If you want to see some stuff on federal violations, look at Fla. They have been making some cases there on HMS stuff over the last year.

I don’t quite get all the uproar over taking fish out of the water for a picture. They have a lot higher percentage of survival after being released after a picture then if they get stuck with a gaff and brought home. If DNR is that worried about the sailfish population, make them release only like the white marlin. It’s stupid that we have a reg that allows the fish to be brought back to dock but not taken out of the water for release. Why take the risk getting busted for taking a photo of them out of the water? Hell stick 'em dry’em out and take the photo at the dock.
