I have posted the federal reg and what the MSA says myself. You continue to only post what the reg says. Just because a reg says something doesn’t mean it’s the ultimate law. Regs have to comply with the MSA, which gives the agencies the authority to write the regs in the first place.
I understand your concerns, and that is why I want to talk to the judge who will decide if a ticket is good or not.
One more time though, why are you fighting a bill that helps rec guys or any guide who doesn’t fish sharks in that particular boat, when the impact on charter guys w fed permitted boats has been described by dnr as “minimal” if anything at all?

The impact on the Charter/Headboat is HUGE in South Carolina and the Grand Strand… This is what is putting the Charter/Headboat guys out of work and business!

I have not talked to anyone much really in the past few weeks. Have been in the fight of my life at work. Dealing with threats, ethical problems all around me that I have had to get around and figure out how to do the right thing, and on and on. It’s not anything anyone wants to do when they grow up- that’s all. People let you down and put you in very bad positions and you lose sleep because you can’t bend your morals. Everyone has been there, and then you get a chance to catch your breath. Today I am off work and need to catch my breath and be still, but I am talking about this instead. maybe that is affecting my tone where you feel that I am attacking you, and I apologize sincerely.
We are the same in how we do everything we can to help our community. I have pushed it to the limit where my job got threatened, and i had to pull it back. I am not independently wealthy or anything and have to work for someone else right now.

Wes sorry to hear you job got threatened over this. I do think it is a good bill as I have said before. Just everyone need to know the truth is all. Good luck with bill and hope everything at work get worked. We do need you there to fight for us. I just fill that the fishermen need to know all side of the story and how it work and how it will help and not so we the charter/headboat guys are not getting slammed for not being there is all.

I AM SO TIRED OF HAVE TO TELL PEOPLE WHO CALL FOR CHARTERS THAT WE CAN CATCH A TON OF BLACK SEA BASS BUT WE CAN KEEP ANY DUE TO THE SEASON IS CLOSED UNTIL JUNE 1ST BY THE GOVERNMENT. Check your facts sir! I paid $100 for a seat on the bus like many others even though I could not attend and let someone go for free in my place. I sold t shirts with “united we fish” on them to raise more money. I worked with both Courtland and AGAT to aid in pulling the trip together.

It looks like the Feds are striking back at states that try this. The Gulf Council is striking back at states for their attempt to manage red snapper in state waters:

Red Snapper Season in the Gulf of Mexico
On March 25, 2013, a temporary emergency rule will publish in the Federal Register that gives NOAA Fisheries the authority to set separate closure dates for the recreational red snapper season in federal waters off individual Gulf of Mexico states. The closure dates will depend on whether state regulations are consistent with federal regulations for the recreational red snapper season length or bag limit. This action was requested by the Gulf of Mexico Fishery Management Council at their February meeting to provide a fairer and more equitable distribution of recreational red snapper fishing opportunities among anglers in all the Gulf of Mexico states.
The federal recreational season for Gulf of Mexico red snapper begins June 1 each year with a 2-fish bag limit. The length of the season is determined by the amount of the quota, the average weight of fish landed, and the estimated catch rates over time. NOAA Fisheries is responsible for ensuring the entire recreational harvest, including harvest in state waters, does not exceed the recreational quota. Therefore, if states establish a longer season or a larger bag limit for state waters than the federal regulations allow in federal waters, the federal season must be adjusted to account for the additional harvest expected in state waters.
If all states were to implement consistent regulations, the 2013 recreational season would be 28 days, assuming the recreational quota is increased to 4.145 million pounds through separate rule-making. However, Texas, Louisiana, and Florida have indicated they will implement inconsistent red snapper regulations for their state waters. Therefore, without this emergency rule, the 2013 federal season would be red

Very true. But Cupka and his cronies at SAFMC don’t care about real data. They will probably make an assumption that SC harvested the entire EEZ quota in five days and shut everything else down… OK, I am half joking about that, but knowing Cupka and gang it would not surprise me.
Either way, as an NC resident I totally support what Rep Goldfinch is trying to do in SC and wish someone in my state had the balls to do it as well.
Squid this plays into support of this bill along with so much else. The governor, senate, and house need to see how bad this problem is and how passionate we, the fisherman, are about it. Bill by bill, step by step we need to turn the table. The SAMFC needs to represent the fishery not some enviro BS science. We need some turn over. Our governor can do that! Need to see the people demanding the change!

Great point skinnee! Need to keeping chipping away at it with bills like Goldfinch’s. Need to keep fisherman in the state house fighting for our rights. Governor needs to see this so people like cupka don’t get back in office. We need a Mark Brown on the SAMFC.
Would also be nice if people like captain Keith would support not only his charter friends but us recreational fisherman too.

I hadn’t checked this string of intense conversation and arguing for a few days. My point of being very disappointed and suprised at no charter guys being there was completely misunderstood by Capt Keith. It sounds like Capt Keith has done more homework and work on the fisheries than i have. Maybe I don’t understand the whole situation as well as Capt Keith and I surely don’t know as much as Phin or Skinnee or Scoutin. I Do know that you have to start somewhere. Thats why i was one of the few people to speak at the courthouse. All the charter guys in charleston do tourism fishing in the summer. Maybe a client wants to catch grouper or snapper or cobia or seabass or whatever else maybe other than reds, trout and flounder. Well I know several guides *****ing about the rules all the time etc etc and they haven’t supported one single issue ever regarding fishing politics. IF your job depends on the fishing rules then you should be there to fight for the fishing rules at every opportunity. You gotta start somewhere. I could name 20 guides (of the 150) right now that make alot of money fishing in charleston and they haven’t done anything EVER about helping protect our fisheries. Sells and others know the master plan for what the govt really wants to do to our fishing and to prevent that from happening we ALL need to be involved every opportunity and this will be a fight until we are all dead probably. We all need to be UNITED with this. This fight will either continue into future generations or it will be lost by then. Every single issue needs to be fought whether it directly benefits something now or not. A state rule change could influence a federal rule change and so on and so forth. Everyone that cares about fishing ( which to me is FREEDOM) needs to stand up for it at every opportunity and i put the charter guys at the TOP OF THE LIST b/c they are making a living off it. We need to work together if any of us are going to keep our freedom to fish and pass it on to the next generation. I am a commercial fisherman who is working hard every day defending our freedom and trying to get others involved. I have made it my full-time job for three years. Major difference for them from our Bsb though. They have significant harvest of snapper in the state waters. We don’t have significant Bsb harvest in state waters to affect the FMP.
Its a clear case of the federal machine versus states rights, and the ensuing battle between the two governmental giants the U.S. Government and the Texas State Government - will have a sharp negative impact on some local fishing charter operators and on many more charter companies from South Padre Island to Key West Florida.
Controversy is brewing over National Marine Fisheries Service (NMFS) rules that require all federally charter fishing vessels to conform to federal regulations regarding the harvest of red snapper and other Gulf fish. The Feds claim certain varieties of Gulf fish are in need of better management. A new regulation limiting the number of red snapper allowed per fisherman was passed down about two months ago. The feds ruled only two legal-size snapper could be taken by each fisherman on a federally-permitted commercial charter in federal waters.
But state wildlife departments in Texas, Alabama and Florida did not agree with the federal evaluation for the more restrictive limits on snapper and selected not to change snapper limits in state waters. In Texas, each fisherman can bag four legal-size snapper per trip - in state waters only. So effectively, fishermen on federally-permitted charter boats could fish federal waters and bag two snapper, then return to state waters where they can bag another four snapper. The result has apparently irritated federal wildlife management officials.
