Re-Classification of Property

I have a good friend who owns a few pieces of property down on Edisto. Recently i was talking to her and she said that they are selling a home and an adjacent lot. I was semi interested in the home, but very interested in the lot. She said that she could sell me the lot, but that it had been deemed as dunes and I wouldn’t be allowed to build. While I am not against keeping dunes free of construction, this piece is definitly not a dune. It is the leftover sand that was pushed up from the three houses built around it, and is full of underbrush and trees. I have seen many other properties that are for sale with building permits in hand that are way more ecosystem rich than this piece.

My question is: Who makes this designation? (City?) Who has the power to reverse it? How do you go about initiating this? What are the chances of getting it changed?

Is this something that is written on the plat of the property? Are you sure that this is not just a description of the land and not a classification? Is this ‘dunes’ classification similar to a ‘wetland’ and has restrictions on development? My thought would be if these were man made by local construction then this is just a description drawn on the plat and has no restrictions.

Haven’t looked into it that in depth, but would say that it is not on the plat. More than likely it was a conversation that was had back in the day. (That’s what I’m hoping) I know for a fact back in the 80s some land owners were told that their land would never be allowed to be developed for one reason or another. i also know that since that time some of those properties have since been built on or rebuilt. I know for a fact a family was told that they would never be able to rebuild on their porperty only to sell for 30% the true value of the property. 5-10 years later there is a brand new 5000 sq. ft house. I have a feeling this is the case with this property.

Would it be possible to go to the town office and ask if they have some sort of restriction on a piece of property if you don’t own it?

Or you could call SCDHEC. I’m sure they can answer any question you have.

I have noticed the for sale sign in the yard that you are talking about for awhile now. I still thought that this property was still in a family debate. That house was moved to that lot in the early 90’s. The lot next door is very sandy and full of cockaburrows. In fact my truck got stuck in the sand before. Had to get pulled out. There are much better lots for sale on Edisto than that one.
