Ok I understand the point, but it was his first and promised not to do it again. I do have one more question for you Experts, non-GREEN people, fish catching machines with all knowledge, that question is as follows, if the fish cannot breath out of the water and is tired and so to say winded after running 250 yards of line, then why do they jump out of the water so much during the fight??? Would they not be better off staying under water so they breathe better and can fight harder so maybe they can live??? Just a thought!!!

Greg, You nailed this one…and I will second Dukmon’s “Jesus”.

Spoke with Sandra with the HMS program today.

“It is the fisherman’s obligation to release the fish with as little stress as possible. This includes leaving it in the water. Technically it is NOT against the law to boat the fish.”

I have to run but more to come. She gave me the site and info. I will post all my findings. Any of you lawyer types that would explain “obligation” vs “illegal” would be helpful.

This info is from Feb/May, 2007.

(a) All Atlantic HMS fishing gears. (1) An Atlantic HMS harvested from its management unit that is not retained must be released in a manner that will ensure maximum probability of survival, but without removing the fish from the water.

(2) If a billfish is caught by a hook and not retained, the fish must be released by cutting the line near the hook or by using a dehooking device, in either case without removing the fish from the water.

Future post need to look something like this.

Today we caught our first sail. As the fish approached the boat a shark made a pass at him. The natural defense was to jump out of the water. When he did he landed on the deck. The crew rushed to get him back overboard but it was too late.:roll_eyes::roll_eyes::roll_eyes: He had already been on board. We were left with no other choice. With tears in our eyes we watched the worn out gasp for air on the deck, my little girl begged me to put him back but I could not, for to do that would violate the law. One of the crew members offered to make the most of the situation and take a pic of the fish so he too could be remembered as a champion of the sea.

We all tried to smile but it was hard. The fish was laid to rest in the box. He fought feriously for his life but the law says he must die now.

When we got back to the docks everyone was dressed in black and a few words were said as we cut him up for crab bait as with all bills they taste like s&%t unless smoked. I will forever find it difficult to fish again as my heart bleeds for the one that could not get away.:roll_eyes:

It’s interesting that the two paragraphs you used are preceded by
NMFS encourages catch and release of Atlantic
billfish, and the use of circle hooks to
maximize post-release survival.

They encourage it, but it in not a regulation.
Until Jan 1 2008, circle hooks are encouraged, but not required.

I would, of course, boat my first sail for a picture before releasing. After that, sails would remain in the water. If you guys would rather I take it home where death is assured, sorry about your luck. I’d rather give it a much better chance of living than in my freezer.

If you’re going to keep complaining, direct it to the proper authorities so that we can have yet another reg.

I see nowhere in this thread that anyone was speaking of the circle-hook rule, thus I do not understand what your point is.

If you want to keep a legal billfish, fine. This whole thread has been about the law pertaining to boating a billfish for a pic, and then returning it to the water.
It is clear that it is against the law. The law does not say that if it is your first billfish, then it is OK.

It is not complaining, it is the law.
